Experts dispute impairment stats in workers' comp claims ...

While some websites and anti-drug organizations have recently reported that 38 percent to 50 percent of all workplace accidents resulting in workers' compensation claims involve drugs or alcohol, most experts are not convinced.

In fact, many experts, whether in North Carolina or elsewhere, are now calling the statistics "bogus" and unattributable to any verified study. The statistic, quoted by several large anti-drug organizations, is often attributed to workplace studies performed in 1992, but neither the Bureau of Labor Statistics or the Occupational Safety and Health Administration claim to have gathered this data.

One of the reasons that many experts doubt these statistics is the way in which workers' compensations are handled in many states. For example, most states will deny workers' compensation claims if the employee filing the claim is found to have been under the influence of drugs and alcohol during the accident. It would be highly unlikely that any claim would be granted, or payment made, in claims where impairment was obvious.

Furthermore, some experts are concerned that the statistics are an attempt to place the blame for a workplace injury on the employee. If that's happening, companies may be foregoing any investigation into whether an unsafe work condition exists that could cause further injuries.

Some experts just point to the 38-percent to 50-percent figures and say their incredulous on their face. One says it basically implies that half of the U.S. workforce is high most of the time at work.

Most states that allow insurance companies to deny workers compensation claims due to drug or alcohol use require that the intoxication of the employee be the only reason for the accident. But the experts tend to agree that in many instances, other unsafe working condition likely will be found, such as defective machinery or improper safety preparations.

(AP) ? Nyjer Morgan denounced his "haters." He suggested he might celebrate by taking a nice, relaxing bath. Then he erupted with a cackle.

All while wearing a helmet in his postgame news conference.

After delivering an RBI single in the 10th inning to beat the Arizona Diamondbacks 3-2 Friday in Game 5 and send the Milwaukee Brewers to the NL championship series, Morgan was taking it all in and letting his oversized, oddball personality out.

"It's a lot, man," Morgan said. "Basically just everything that I've had to overcome, just the stuff that people go out there and perceive about me, everything. Just all my haters. I just wanted to show them that I can play this game, even though I have a fun, bubbly personality. I still come to win, and I'm a winner."

The Brewers would expect nothing less from their rabble-rousing, run-producing force who often refers to himself by the name of his self-created alter ego, "Tony Plush." Morgan might have worn out his welcome with other teams, but he's winning over the Brewers and their fans.

"He's a joy to have, I'll tell you," Brewers manager Ron Roenicke said. "I don't care about all the little issues we have. This guy, I love him on this team. I like him as a really nice young man. He came through big, again, when we needed him."

Next, the Brewers face NL Central nemesis St. Louis after the wild-card Cardinals beat Philadelphia 1-0 in Game 5 of their series Friday night. Milwaukee will open at home against St. Louis on Sunday.

With the game tied at 2 in the 10th and Carlos Gomez on second base with one out, Morgan hit a grounder up the middle and Diamondbacks closer J.J. Putz tried in vain to stop it with his leg. The ball went into center field and Gomez sailed across home plate as a wild throw home went awry.

Gomez was surprised when one of the first people to greet him on the field at raucous Miller Park was Brewers principal owner Mark Attanasio.

"You have to be smart," Gomez said. "You have to get to the boss first, and then your teammates."

Morgan was mobbed by the Brewers near the mound after the latest dramatic finish for baseball's best home team gave Milwaukee its first victory in a postseason series since it won the AL pennant in 1982.

"We've heard all about 1982, so it's nice to start our own legacy," slugger Ryan Braun said.

Arizona did all it could to extend its surprising season. Center fielder Chris Young made a jaw-dropping catch in the sixth and the Diamondbacks had one last comeback left in the ninth.

"I'm not ready to go home yet," Young said. "I'm not hanging my head because I think we could have done anything different. I'm hanging my head just because I want to keep playing and I don't want the season to be over yet."

Willie Bloomquist drove in the tying run with a safety squeeze, but Arizona was unable to forge ahead against closer John Axford.

"This was a great baseball game today. I'm not happy to be on this end of it. Yet I'm proud of my team and they played true to the way they played all year," Arizona manager Kirk Gibson said.

"And the Brewers, they cashed in on their opportunities, what can we say? We had tons of opportunities."

Morgan was a critical addition for the Brewers this year and had several clutch hits, winning fans along the way.

"Nyjer got the biggest hit of his life, one of the biggest hits in Brewers history," Braun said. "We're all proud, man. It's pretty cool."

But Morgan wasn't having a particularly productive series until his big moment in the deciding game ? although he bristled at the suggestion that he was struggling.

"What struggles?" Morgan said. "It's baseball, man."

Afterward, the Brewers spent more than an hour celebrating with thousands of Miller Park fans who stuck around. Attanasio ran out onto the field immediately after Morgan's game-winning hit and grabbed Gomez.

"I've never done that," the owner said. "I was so excited. I could not contain myself."

Then, the principal owner who bought the team from the Selig family in September 2004, continued to party by high-fiving fans while standing on top of the first-base dugout.

"It's emotional, man," Prince Fielder said. "You just feel the work and everything. Everything is paying off."

The party continued for even the youngest Brewers.

The sons of Fielder, Yovani Gallardo and Corey Hart all pumped up the crowd, waving their arms for more noise before doing the "Beast Mode" celebration that the Brewers have rallied around.

The scene was similar exactly two weeks earlier when Milwaukee captured its first division title since winning the AL East in 1982.

That was also the last time Milwaukee won a round in the postseason, when it captured the American League pennant before losing in seven games to St. Louis in the World Series.

With a 2-1 lead and their tough 1-2 bullpen combination of Francisco Rodriguez and Axford lined up for the eighth and ninth Friday, the Brewers appeared to have their ticket punched to the NLCS.

But the Diamondbacks had the most comeback victories in the majors this season (48) and weren't about to go away easily.

They nearly got the best of Rodriguez in the eighth. He loaded the bases with two outs for Ryan Roberts, one of two Diamondbacks players to hit a grand slam in the series. But Rodriguez got Roberts to ground into a forceout at second base, ending the threat.

Axford pitched the ninth, allowing a leadoff double to Gerardo Parra. The reliever nearly hit Sean Burroughs with a pitch, then Burroughs blooped a single to put runners on first and third.

Bloomquist pushed a bunt to the right side and Fielder nearly collided with Axford while fielding the ball. Fielder stumbled and was unable to get off a throw to the plate as the tying run scored.

Justin Upton grounded into a forceout at second and Henry Blanco hit a grounder to shortstop. Yuniesky Betancourt fielded the ball and barely beat Upton to second base to end the inning ? although Betancourt paid for it, getting spiked in the leg.

Axford ended the regular season with 43 straight saves, and saved Game 1 of the series. He had not blown a save chance since April 18 at Philadelphia.

Gallardo gave up one run in six innings. The right-hander threw 112 pitches, allowing six hits while walking two and striking out five.

Axford got the win despite a rough outing. Putz took the loss.

"We've had great comebacks all year. Unfortunately tonight, we weren't able to finish it off," Gibson said.

After finally edging Arizona, the Brewers sprayed bubbly in the clubhouse and waited to find out who their next opponent would be. The Cardinals' win meant the first game of the NL championship series will be Sunday at Miller Park.

"I think we've done all our celebrating," Roenicke said. "I know I have. So, yeah, I'll sit back and watch what's going on with those games to see if we're staying here or we're going on the road tomorrow."

NOTES: Despite 78-degree temperatures and sunny conditions at game time, the retractable roof to Miller Park was closed. Both managers said before the game that they didn't care whether the roof was open or closed, although Roenicke said he didn't mind having similar conditions to the previous games in the series. ... Panthers QB thriving without using crutches most teams use for rookies

Cam Newton is having a stellar rookie season, but Mike Tanier breaks down just how effective he's been.

Cam Newton camdemonium has quieted ? for the time being.

The excitement of his back-to-back 400-yard games to open the season gave way to the reality that the Panthers lost both games. When the Panthers did win, they beat the woebegone Jaguars in monsoon conditions, and Newton?s statistics ? 18-of-34, 158 yards, one passing touchdown, 27 rushing yards ? were as soggy as the Charlotte mud that day. Newton threw for 374 more yards and ran for a pair of touchdowns against the Bears on Sunday, but the buzz has faded. It was another loss, and we have moved on to other activities, like making fun of the Eagles.

Somewhere between the giddy hysteria of Newton?s hot start ? ?Cam Newton Ties Rookie Record For Most Losses in First Two Games? was the headline that best summed up our brief obsession ? and the ho hum reaction to his last few games lies the real truth about the Panthers quarterback: He is very good.

And he is getting better.

Newton is going to generate a lot of exciting while losing games this year, but the real reasons to get excited aren?t his highlight-reel passes, but his good decisions. With the spotlight off of him, Newton is taking the first steps to grow from a scramblin? video game character into an efficient all-around quarterback.

Timing is everything

Figure 1 shows the Panthers facing 2nd-and-13 while trailing 24-10 to the Bears in the second quarter. Note the formation: Newton under center, tight ends Greg Olsen (88) and Jeremy Shockey (80) to the left, two receivers to the right. Newton is not in shotgun, and this play uses no spread or option principles. The Panthers do use many option-type plays to exploit Newton?s running talents as they are not heavily dependent on them. That?s because, as this play shows, Newton is already becoming comfortable as a pocket passer.

The Bears give Newton an easy Cover-2 pre-snap read. Note that there is no defender directly covering Legedu Naanee (17), and that Bears linebacker Brian Urlacher (54) is lined up extra deep so he can run up the seam. This offensive play is designed to attack Cover-2: Steve Smith (89) runs a crossing route to keep Urlacher and the other linebackers from dropping deep into coverage. Olsen also runs a short route to ?hold the level? of the zone defense. That opens up the seam for Shockey.

The key to the success of a pass like this is timing. If Newton gives up on the play too early, he misses the split second when Shockey flashes open. If he waits too long, Urlacher and the safeties can arrive to break up the play. Newton is actually a fraction of a second late on this pass, but he delivers a perfect strike with plenty of velocity. Shockey hauls in a 15-yard reception, and the Panthers score a touchdown a few plays later.

Newton?s timing is not yet perfect on passes like these, but it is excellent for a player that spent his career in a shotgun-spread offense and barely had an offseason in which to adjust to the NFL. Plays like these allow the Panthers to keep their best weapons, including tight ends Olsen and Shockey, on the field and in their traditional roles, instead of shuttling receivers in and out of the game to set up quarterback draws and screen plays.

Of course, Steve Smith is still the Panthers? best weapon. Newton has proven that he can find Smith, even when he is not looking for him.

Checking it down
Smith caught eight passes for 181 yards against the Bears, including a wide-open 53-yarder that made the Sunday ?Gamebreak? highlights. The 53-yard catch was a simple coverage lapse, so it told us little about Newton except that he can hit a receiver who does not have a defender within 20 yards of him. Later in the first half, Newton hit Smith for a shorter pass that demonstrated his ability to hang in the pocket and find a secondary target.

Figure 2 shows the Panthers on first down just before the two-minute warning. Note again that Newton is under center and the Panthers' base personnel is in the game, with Olsen playing fullback this time. The Bears again show Cover-2, but they have a surprise up their sleeves. Just before the snap, safety Major Wright creeps closer to the line of scrimmage, and the cornerbacks drop a bit. This is not Cover-2, it is Cover-3, meaning that the deep middle and sidelines are off limits.

The change in deep coverage could spell trouble for the Panthers. This pass pattern, like the one in the last diagram, works best against two-deep coverage. When Nanee and Shockey cross behind the linebackers, the cornerback is supposed to be stuck covering Shockey, isolating Naanee against the safety. In Cover-3, there is another safety waiting right where Naanee wants to run, and Wright runs underneath the routes to make the throwing lanes uncomfortably tight. The replay shows Newton looking for Naanee at the start of this play. Throwing to him would be a big mistake.

Luckily, Newton checks down, and Smith is a heck of a player to be able to check down to. Smith knows the coverage and knows his cornerback must stay back in an extra deep zone, so he settles into a soft spot and waits. Newton spots him, and most importantly, fires the pass off immediately; any delay would make it easy for the Bears to converge on Smith. Smith makes the catch, makes a cut, and gains 29 yards. The Panthers get a field goal out of the drive.

Making things happen
The biggest compliment I can give Newton four weeks into the season is this: the Panthers' offense funnels through him.

Watch a rookie quarterback like Blaine Gabbert or Andy Dalton, and you can see the training wheels on the offense. There are lots of screens, rollout passes to the tight ends, and other plays designed to keep the reads easy and the throws short. They run the same gameplans that backup quarterbacks run, the kind that takes the game out of the quarterback?s hands.

Newton is not running that game-manager, don?t-screw-it-up gameplan.

He throws downfield. He throws past the sticks on third-and-long. He has his custom plays, particularly near the goal line, but those plays are designed to emphasize his talents, not hide his flaws. Newton has thrown some interceptions, he has fumbled, and he has delivered a lot of passes late or a little too high, but that is because he has been good enough to earn the opportunities to make those mistakes instead of handing off and punting.

Newton is on pace to throw for 5,500 yards, 20 touchdowns, and 20 interceptions. He is more likely to throw for 4,000 yards, but the touchdown and interception projections appear dead on, with 500 rushing yards to boot. The Panthers will be absolutely thrilled with those numbers, and more importantly, with a quarterback they can trust both on the run and in the pocket.

The head of the UN Children?s Fund (UNICEF)? today called for the urgent protection of children in Yemen who are being caught in the crossfire of the civil unrest that began earlier this year.?The children of Yemen should be busy going back to school at this time of year. Instead, they face armed men rather than teachers, bullets instead of books,? UNICEF?s Executive Director Anthony Lake said in a? statement.

?In this deepening humanitarian crisis, UNICEF calls for the urgent protection of women and children and a return to normal life so children can at least attend school in peace,? he added.

According to the agency, at least 94 children have been killed and 240 wounded by gunshots or shelling since the clashes between security forces and protesters seeking to oust President Ali Abdullah Saleh began earlier this year. At least two were killed just this week.

Mr. Lake urged all parties to do their utmost to spare civilians, especially women and children. ?The crisis in Yemen has the biggest impact on the most vulnerable, children, many of whom need assistance now and require help in the longer term if they are to recover.?

Malnutrition rates were ?alarmingly high? in the country even before the current violence broke out, he noted, and its impact on the poorest people has only been compounded by rising food prices and collapsing basic health services.

Of 3.6 million children under five years of age in Yemen, at least 43 per cent are underweight and 58 per cent are stunted.

?The deadly combination of widespread poverty and malnutrition, especially among children, is sweeping the country. Child malnutrition rates are already well above emergency levels in parts of the country and are as bad as malnutrition rates in some of the worst countries in the world, which receive more international media attention,? said Mr. Lake.

?The country is sinking deeper into a humanitarian crisis,? he added. ?The people of Yemen need our attention and help now. There is not a moment to lose.?

The clashes in Yemen are part of a wider wave of popular uprisings in the Middle East and North Africa that has already toppled regimes in Tunisia, Egypt and Libya.

Secretary-General? Ban Ki-moon has called numerous times on the Government and opposition groups in Yemen to engage with his special adviser, Jamal Benomar, to peacefully resolve the ongoing crisis in the country.
