Priceline sends Shatner's Negotiator over a cliff (AP)

LOS ANGELES ? William Shatner's stalwart Capt. James T. Kirk died in the line of duty. Now the actor's bargain-touting Priceline Negotiator is headed heroically to his final frontier.

In a new 30-second TV spot set to begin airing Monday, the Negotiator rescues panicked vacationers from a bus teetering on a bridge's railing.

"Save yourselves ? some money," he says, handing his cellphone to a passenger as he and the bus tumble into a dry creek bed. A violent explosion, real and computer-generated, follows.

"I'm in grief mode," a droll Shatner said by phone Wednesday. "It's not the first time I've had an iconic character die off."

He's been a pitchman for Priceline for 14 years, five of those as the relentless Negotiator preaching the gospel of travel bargains. But an advertising change was needed to reflect the company's broader strategy, said Christopher Soder, CEO of Priceline.com North America.

"The challenge is harder to get people's attention than it used to be. ... So we decided to do something really over the top to get the message across," Soder said. The new spot will be on his company's website and, he hinted, may be part of next month's Super Bowl commercial extravaganza.

Shatner promoted Priceline as a site where travel prices are subject to bidding. But Priceline is also a set discount-price booking site for more than 200,000 hotels in 140 countries, an expanding service that is not widely known by consumers, Soder said.

The new direction makes sense, according to a marketing strategist.

"It's a tough decision, but the bottom line is Priceline had to do it," said Peter Sealey, adjunct professor at the Claremont Graduate University's school of management. "They're changing their business model from a name-your-price model to a fixed-price approach."

Shatner's Negotiator was just too good at representing the old approach, Sealey said.

"Had he been less effective, he could have been allowed to fade away," he said. "I don't know if I would have gone as far as the bus exploding."

Shatner, whose Kirk arguably had a less memorable death in 1994's "Star Trek: Generations," is philosophical about the turn of events. He's looking ahead to the debut next month on Broadway of "Shatner's World: We Just Live in It," his one-man show.

"It was a great run," the Emmy-winning actor ("Boston Legal" and "The Practice") said of the Priceline gig. But "if the management says this is the end, this is the end."

Is it? Could the Negotiator be resurrected? Or might Shatner, who previously appeared as a troubadour in spots for the website, play another role for Priceline?

"I'm not going to speculate on future campaigns," said the company's Soder.

Great pitchmen have been born from the ashes before. Fast-food chain Jack in the Box's commercials routinely feature "Jack," a man wearing a version of the clown-faced symbol that the company dramatically blew up in 1980 to signal a menu change ("Waste him," an elderly female customer said in the spot). Some Americans were upset by Jack's demise.

Does Soder fear backlash from those fond of Shatner and the Negotiator?

"We certainly hope not. We had a great, long association with Mr. Shatner," Soder said, adding hastily, "I didn't mean to use the past tense. He's still under contract with us."

True, said Shatner, an indefatigable 80 years old. So whether they use him again or not, he said merrily, "I'm going to make them pay through the nose."

Top-side brief in Southern Union explains why Sixth Amendment Apprendi rule applies to fines

All Apprendi/Blakely fans (and, for that matter,?all Apprendi/Blakely haters) will want to check out this SCOTUS?merits brief from the petitioner in Southern Union v. US, which was filed last week.? Here is the start of the brief's statement of the case

This case raises the question whether the principle that this Court recognized and applied to sentences of incarceration in Apprendi v. New Jersey, 530 U.S. 466 (2000), and its progeny, applies equally to the imposition of criminal fines.? At the outset, the Court might wonder what the argument could be that the Apprendi principle does not apply to criminal fines, given that this Court?s explicit holding in Apprendi was that any fact that increases the ?penalty? for a crime must be submitted to the jury and proved beyond a reasonable doubt, and criminal fines are unquestionably ?penalties.?? Indeed, prior to the decision below, federal and state courts uniformly held (or assumed) that Apprendi applies to the imposition of criminal fines.? Even the United States agreed that the Apprendi principle applies to fines.

The decision below is the first to hold otherwise.? It did so based on the court of appeals? view that this Court?s opinion in Oregon v. Ice, 555 U.S. 160 (2009), announced a whole new methodology that fundamentally narrowed the Apprendi doctrine and also suggested that a court can use non-jury fact-finding to impose a fine that exceeds the maximum fine set by the legislature, which is what happened in this case.? As shown below, this reading of Ice, a case which did not involve a criminal fine, is fundamentally flawed and ignores the fact that Ice was an exceedingly narrow ruling.? In particular, the court of appeals? historical understanding was at a minimum incomplete, and in all events did not support its conclusion that fines are outside the scope of Apprendi.

This Court should reverse the court of appeals? holding because it would deprive criminal defendants of their fundamental jury trial rights in cases involving fines, and should vacate the fine imposed in this case (which was 360 times greater than that authorized by the jury?s verdict).

Many hard-core Apprendi/Blakely fans were justifiably puzzled by Ice, and this new case presents the Court with its first opportunity to explain if and how Ice was meant to recast the Apprendi/Blakely Sixth Amendment rules.? Also, Southern Union will present the first crisp opportunity for the two newest Justices to indicate how they view Apprendi/Blakely Sixth Amendment rules, which could of course have profound long-term implications for all sorts of punishments beyond fines.

Fuel to start flowing to iced-in Alaska town

Crews have laid a hose along a half mile stretch of Bering Sea ice and were hoping Monday to soon begin transferring 1.3 million gallons of fuel from a Russian fuel tanker to the iced-in western Alaska city of Nome.

The offloading could begin before sundown Monday, said Stacey Smith of Vitus Marine, the fuel supplier that arranged to have the Russian tanker Renda and its crew deliver the gasoline and diesel fuel.

Crews on Monday hooked the arctic-rated hose to a shore-side pipeline leading to storage tanks in town and were safety-testing the hose with pressurized air, Smith said.

State officials said the transfer must start during daylight, but can continue in darkness. Nome has just five hours of daylight this time of year.

The transfer could be finished within 36 hours if everything goes smoothly, but it could take as long as five days.

The Renda is moored roughly a half-mile from Nome's harbor after a Coast Guard icebreaker cleared a path for it through hundreds of miles of a slow journey stalled by thick ice and strong ocean currents.

Smith said the effort is a third of the way into completion with the arrival of the Renda to Nome. Pumping the fuel from the tanker will be the second part. The third part will be the exiting through ice by the two ships.

"It's just been an absolutely grand collaboration by all parties involved," she said of the work accomplished so far.

STORY: Ultra-harsh winter prompts fuel shortages in Alaska

The city of 3,500 didn't get its last pre-winter barge fuel delivery because of a massive November storm.

Without the Renda's delivery, Nome would run out of fuel by March or April, long before the next barge delivery is possible after one of the most severe Alaska winters in decades.

The 370-foot tanker began its journey from Russia in mid-December, picking up diesel fuel in South Korea before heading to Dutch Harbor, Alaska, where it took on unleaded gasoline. It arrived late last week off Nome on Alaska's west coast more than 500 miles from Anchorage.

In total, the tanker traveled an estimated 5,000 miles, said Rear Adm. Thomas Ostebo, commander of District Seventeen with the Coast Guard.

Once the hose was laid, personnel would walk its entire length every 30 minutes to check for leaks, said Jason Evans, board chairman of the Sitnasuak Native Corp., which owns the local fuel company, Bonanza Fuel and has been working closely with Vitus Marine.

"We hope to be pumping fuel this afternoon," he said Monday.

Each segment of hose has its own spill containment area, and extra absorbent boom will be on hand in case of a spill.

The Coast Guard is monitoring the effort, working with state, federal, local and tribal representatives, said Chief Petty Officer Kip Wadlow. The fuel participants had to submit a plan to state environmental regulators on how they intended to get the fuel off the Renda, he said.

"We want to make sure the fuel transfer from the Renda to the onshore storage facility is conducted in as safe a manner as possible," he said.

The tanker got into position Saturday night, and ice disturbed by its journey had to freeze again so workers could create some sort of roadway to lay the hose.

Tips For Creating A RP

I spent most of my role playing years in what I knew best as free-form role playing in public chat and only found solid, story-structured role plays on AOL for about a year and this was 7 years ago so needless to say I have only role played for maybe a total of a few months over the past 7 years; free-form or otherwise. While I have not been able to be on as often as I have liked since joining, I have not seen such promising role play since joining the RPG site nor have I ever felt more compelled to try to start my own role play.

While I haven't really role played in years, I have never stopped writing so I only feel a tad bit rusty during RP interactions. I have never been a GM or even a co-GM for a role play but I feel pretty confident about my story structuring. What I am finding the most difficult to grasp about starting my own role play is how to structure a story or even an outline while allowing my Players to maintain free will in their posting. I find it difficult to imagine working an entire story around the reactions and styles of others who at the very most will differ very much from each other.

I'd also like to keep this thread open where you can post up your own questions for being a GM or even if you'd like to offer random advice on the subject.

Tuareg rebels attack towns in north Mali (AP)

BAMAKO, Mali ? A new Tuareg rebel group, whose members include former pro-Gadhafi fighters, says they have launched attacks in several towns in northern Mali. One eyewitness said heavy weapons were being fired and Mali military helicopters have engaged the rebels.

The National Movement for the Liberation of the Azawad (NMLA) said Tuesday the main fighting is ongoing around the town of Menaka.

Moussa Ag Acharatoumane, one of the leaders of the NMLA, told The Associated Press by telephone from Paris: "Our aim is to liberate these towns." He said he had no information about casualties.

The Malian Defense Ministry and the presidency had no immediate comment.

Members of the Tuareg ethnic group live in several nations in northwest Africa.

Coats provide a hedge against financial chill (AP)

MILAN ? Given the economic gloom, safe, long-term investments are definitely in fashion. And designers are banking on the overcoat, which made a big comeback on the Milan runways during menswear fashion week, which ended Tuesday.

A rich, red long overcoat with astrakhan fur lapels modeled by Adrien Brody at Prada earlier in the week was emblematic of the winter look.

Shearling, hardy and multipurpose yet fashionable, is the darling of the season. But there also will be an array of elegant evening coats of such luscious materials as astrakhan and velvet ? not only as accents, but as full-fledged outerwear.

Styles ranged from businesslike double-breasted to winter-ready trench coats. There was no end to the detailing, from peacock feathers to military broaches to studs and silk embroidery. Designers also mixed materials, combining leather and tweed, wool and velvet, fur and fabric.

For a more casual look, fashion houses offered hooded duffle coats and pea jackets. There were few sportier styles, although biker jackets, bombers and parkas made cameo appearances.

Overall, the message was conservative. Jackets tended to be short and close to the body, and pants were mostly skinny with some more relaxed looks.

Layering was in, and turtlenecks were substituting for ties even for evening. Knitwear was geometric and floral patterns graced just about any garment.

Total black was the season's favorite tone ? perhaps wishful thinking for the balance sheets. Overall the palate was traditional urban, with just sparks of teal, peacock blue, red and purple.

Much of the flash was reserved for accents, like silver details on footwear or shimmery fabric for shirts and jackets.

If all this was too much austerity, then ostentatious studs glammed up some wardrobes.

Bags were flat, for the work laptop, or roomy, for travel getaways. Velvet slippers were big, contrasting with heavy biker boots. The classic laceup and fringed moccasins were sure bets for the season.

Leave it to Mr. Armani to prove that comfort and elegance can share the same closet.

His menswear winter 2013 collection had all the items a well-turned-out gentlemen needs, and yet was as comfortable as a pair of jeans and a sweat shirt. The secret lies in the materials: knitted wool and stretch fabric. The ample cut of the clothes does the rest.

An iconic double-breasted coat ? the number one item on a man's shopping list for next winter ? comes in knitted wool. A gray business suit is crafted in super soft stretch fabric and has a short deconstructed jacket and pants with extra wide darts. A velvet Tuxedo jacket is worn with a simple silk T-shirt.

On the other side of the coin, Armani takes top-drawer pieces and transfers them into casual wear worthy of fancy dress.

Armani drew inspiration for his winter palette from Alpine scenery: boulder gray, bright sky blue, and Dolomite red, the color of the mountains surrounding Cortina d'Ampezzo, one of Italy's most exclusive ski resorts.

At Versace, the motto for next winter is clearly: Glitter, never enough!

Donatella Versace covered her menswear creations in golden studs, and then sprinkled them with Swarovski crystals.

The collection presented in the covered garden of her Milanese palazzo started off quite button-down: A dark blue pinstriped suit with a baby blue shirt and silver tie. Golden buttons provided the only bling.

But it didn't take long to turn up the heat, with denim outfits covered with large golden rivets, adorned with bright wool collars in green or yellow. The rivets completely covered the denim in one pair of cropped jeans.

Donatella wasn't color-shy. Two frolicking denim outfits in bright floral print conjured images of 1970s playsuits. A bright red tailored suit was paired with a bright pink turtleneck, a fire-engine red jacket with a green turtleneck.

Then, suddenly, the lights went down, and the glam went up. A sheer black shirt with crystal accents, worn with tuxedo trousers. A leather jacket with crystals on the back, and studs on the arms.

For accessories, a heavy gold chain provides security for oversized leather wallets stuffed in back pockets. Motorcycle boots with gold accents completed the "Don't mess with me!" attitude.

The transgressive designing duo Dean and Dan Caten, opened the last day of the menswear preview collections for next winter with a relatively somber DSquared2 collection-showing the twins are in tune with the tough economic times.

To the rock beat of "The Wall" by Pink Floyd, the Canadian duo sent out models in tight, low-waisted cropped jeans, worn with a short jacket. By night, the designers offered several outfits with studs or graffiti.

But that was as bad-boy as it got. The rest of the show was devoted to classic styles, the same kind seen on most of the runways throughout the four days of preview showings.

Knitted vests, tweed coats, mohair sweaters and suede jackets all stayed on the safe side, where fashion has retreated for the moment. Ditto for the formal tuxedo suit that closed the show, worn with classy patent-leather boots.

(AP) ? Syracuse is still perfect.

Ranked No. 1 for the sixth straight week, the Orange won their 20th straight game on Monday night, beating scrappy Pittsburgh 71-63.

It was win No. 876 for coach Jim Boeheim, tying him with Adolph Rupp of Kentucky for fourth place all-time in Division I. North Carolina's Dean Smith is third with 879.

The Orange (20-0, 7-0 Big East) set a school record for most consecutive victories to start a season, and seniors Scoop Jardine and Kris Joseph achieved their own meaningful moment: Neither had ever beaten the Panthers.

"The best start in school history and beating Pitt, this is something I'll always remember," said Jardine, who had 12 points and 10 assists, his second double-double in five games. "Coach is going to keep breaking records. We're trying to do something special here. We just have to stay focused on the task at hand."

Dion Waiters led Syracuse with 16 points and Joseph had 12, none more important than his 3-pointer with 8:22 left after Pitt had crept within 53-49.

"I've been part of history a few times ? 34,000 crowd (at the Carrier Dome), this right here," Joseph said. "We'll never be forgotten. It's great. Tonight was for Coach."

Joseph and Brandon Triche both had 12 points for Syracuse, while Fab Melo had 10 points, 10 rebounds and six blocks before fouling out in the final minute.

The win snapped a five-game losing streak to Pittsburgh (11-8, 0-6).

"It's the first time we've beaten Pitt in a while and we got Coach's win to put him up in the ranks," Joseph said. "It was a great night for us. That's big-time (tying Rupp)."

Pittsburgh, which has lost seven straight, had stopped Syracuse's season-opening winning streak at 18 games a year ago, and the Panthers seemed poised to do it again. They overcame a 13-0 deficit at the outset and pulled within 53-49 on Talib Zanna's jumper with 8:36 to go.

Syracuse responded as it has all season.

Waiters drove the lane and dished to a wide-open Joseph on the wing for that critical 3. It was Waiters' only assist of the game. Then, after Pittsburgh's John Johnson missed from long range, his only miss in four shots from beyond the arc, Waiters swished a 3 from the left wing and the lead was back to 10.

"You get in these games, you just have to make plays and we did," said Boeheim, who extended his Division I record for most 20-win seasons to 34. "It's not always good to get into these games, but when you do you have to make some plays and make your free throws."

Pittsburgh (11-8, 0-6) never got closer than eight points and could only lament what might have been. Too many missed layups and 11 missed free throws only extended the misery of the Panthers' losing streak.

"We responded well," said Ashton Gibbs, who finished with 10 points on 4-of-12 shooting. "We missed 11 free throws and we lost by eight. I think that was the difference. We make layups and make free throws, we win the game."

It was Pitt's first game against a top-ranked team in nearly three years. The Panthers brought a 2-13 record in those games into the Carrier Dome, but those two wins came in succession against Connecticut in February and March 2009.

Much has been made of Syracuse's depth this season as the Orange, led by Waiters, have consistently outscored the opponent's reserves. On Monday, the Panthers' reserves held a 30-25 edge.

"At the end of the day, there were a couple of times where we didn't go as strong to the basket," Gibbs said. "There were a couple of times where we should have dunked the ball instead of trying to go for layups. That's just the learning process of it."

The Panthers were coming off a stunning 62-39 home loss to Rutgers on Wednesday, the fewest points they scored in a regulation game since a 53-30 loss to Temple in 1969.

"Pittsburgh's a good team. I don't care what their record is," Boeheim said. "They're going to win a lot of games in this league. They've been a little unlucky in some of their losses."

Cameron Wright and Lamar Patterson also scored 10 points for Pitt, which had won 13 of the past 16 meetings with the Orange. Nasir Robinson, Pitt's second-leading scorer at 12.4 points per game, had four points and missed 6 of 8 free throws.

The Orange, who matched the longest run in school history at No. 1 ? set at the start of 1989-90 ? travel to Notre Dame on Saturday.

As he always does, Boeheim, now 67, brushed off talk of his accomplishment in a season that has been far from perfect off the court with the firing of associate head coach Bernie Fine in late November amid allegations of sexual abuse involving two former ball boys. A federal investigation is ongoing.

"The only thing I care about this year is what we're doing this year," Boeheim said. "When you get real old, maybe next year, I'll think about it."

Syracuse's last home win against the Panthers was 67-65 on Feb. 1, 2003. Syracuse's last win over Pitt was 65-61 in the 2006 Big East tournament championship game, and its last victory during the regular season was 49-46 in overtime in February 2004 at the Petersen Events Center.

"We didn't finish," Pitt coach Jamie Dixon said. "In the second half, we finished a little better. We attacked it pretty well, maybe some more penetration out front would have been good for us, but we're still trying to get better in that area. It seemed like we were getting inside touches. We maybe took a few too many 3s, but for the most part we did not settle for 3s."
